"I was called down to the front and Fisher was leaving the building with the security officer following her. I followed them out of the building to Fisher's car," he said. "Fisher got into her car and then I called the police again, just to notify them, to say what had happened and gave them the car registration details in case she drove off." He said Fisher appeared anxious but relaxed when he told her he had called police again.

Prosecutors have alleged Fisher assaulted Ms Groot in the carpark as she tried to leave the premises by pushing her out of the way of her car and then slamming her driver's side car door into Ms Groot's arm.

Michael Abbott, QC, for Fisher, said the evidence against his client from Ms Groot was inadmissible because it was obtained unlawfully. He argued that Ms Groot was not authorised, by way of her restricted security agent's licence, to detect and investigate potential property theft.

This morning a representative from the Office of Consumer and Business Services gave evidence that Ms Groot was entitled to carry out those functions under her authority to perform "guard work".

Krystle Bobridge, acting senior supervisor for licensing for the department, said security agents were permitted to guard people and property as well as prevent, detect and investigate potential offences with regards to people and property.

The trial, before Magistrate Kym Boxall, continues.

ACCUSATIONS of stealing groceries left senator Mary Jo Fisher feeling ripped apart and out of control.

Fisher told the Adelaide Magistrates Court yesterday that said she was battling chronic depression and a severe panic attack last year when an alleged incident occurred at Frewville Foodland.

"I think it all collided on December 15," she said.

Fisher, 48, described depression as her "dark secret", and one that led to self-doubt.

"You think you're crap," she explained. "You think you're not good enough to do what you're doing. It's all negative, sir. Every day is a struggle, sir.

"And when you're not in that place, you can't believe you would ever be in that place, but when you're in it you feel you will never get out of it."

Fisher said that a month before the alleged incident she had changed medication.

She said that change had had a "severe and urgent" effect on her health and behaviour.

"I was zoning in and out; it was almost like my brain was twanging," she said.

"When I was in the course of reducing (one medication) I thought part of the reason leading up to that was getting me out of the pits of despair, the feeling of hopelessness and the feeling of being inadequate and not up for the job."

Police allege Fisher paid $7.30 for several grocery items before stealing $92.92 worth of fruit and vegetables from the supermarket.

LIBERAL Senator Mary Jo Fisher broke down briefly in an Adelaide court as she told her trial for shoplifting and assault about her battle with depression.

The South Australian senator took the stand in the Adelaide Magistrates Court today at her trial for allegedly stealing $92.92 worth of food from a Foodland store in Adelaide on December 15.

She has pleaded not guilty to that charge and not guilty to also assaulting a store security guard who tried to stop her leaving.

Senator Fisher, 48, broke down as she told the court she suffered hot flushes, trembling and sweats.

"Basically I wasn't in control," she said.

Her trial continues.

Prosecutors say a psychiatrist was biased in his evidence Senator Mary Jo Fisher was suffering from a panic attack when she allegedly stole groceries from a supermarket.

The South Australian Liberal Senator did not attend an unscheduled hearing called in Adelaide Magistrates Court on Monday.

Prosecutors sought to reopen their case to call rebuttal evidence.

Senator Fisher is on trial for allegedly stealing $92 of groceries from a Foodland store in Adelaide last December and pushing a store security officer who approached her in the car park.

The court was due to hear final submissions next week, but prosecutors asked to call evidence from psychiatrist Dr Ken O'Brien, saying he believed the evidence defence psychiatrist Dr Brian McKenny gave at trial about Fisher's panic attacks "lacked objectivity and showed an element of bias".

Well, the Prosecutors would say that. That sort of assertion tends to happen all the time in such cases - a bit of shopping around for opinions with the bias you want occurs in such cases.
Mostly the lawyers don't get the bias they would like, but Adelaide did once have a Neurosurgeon who, by repute, could never find any illness in anyone who made a WorkCover claim..

I don't know the other guy, but I've known Ken O'Brien for years, and I would expect he would not intentionally offer a biased opinion.
However, his clinical views are fairly conservative and his politics are definitely Left.
Doctors in any field who would deliberately take sides are rare, but differences of perspective are common..

In my days of doing a lot of WorkCover work some lawyers tried to suggest I was biased in favour or the workers' and unions' views because some unions referred to me..
(That was despite my open Liberal Party affiliation, and I like to think that was because I was fair..)

New twist in Liberal Senator Mary Jo Fisher shoplifting case

A COURT will hear further expert medical evidence about the mental health of Liberal senator Mary Jo Fisher at the time she allegedly shoplifted groceries.

Today prosecutors and lawyers for Fisher argued their case about allowing Dr Ken O'Brien to give rebuttal evidence to that given by the senator's treating psychiatrist, Dr Brian McKenny.

Sergeant Brendon Beh, prosecuting, said a report from Dr O'Brien refuted claims made about Fisher's mental capacity at the time of the alleged offending.

Prosecutors have alleged Fisher stole $92.92 worth of fresh groceries from Frewville Foodland in December last year.

Sgt Beh said Dr O'Brien had "trouble" with Fisher allegedly stopping in a supermarket aisle to pack and repack items in her personal canvas trolley moments before proceeding to the checkout.

Prosecutors allege she only paid for some items before proceeding to leave the store. They have also accused her of later assaulting a store security officer as she tried to leave the premises a second time.

1. One could argue that the behaviour could correlate with increased obsessional behaviour associated with mood disorder as they do go together often.
2. He is quoted as saying he had "trouble" with it, not that it proved anything one way or another - there is uncertainly in interpreting behaviour that lawyers like to try to turn into absolutes.

Whitlam was a goose that's why we sacked him. Hopefully Gillard is next. She won't need to be sacked she and her rabble will fall at the ballot box.

Cue Simon Crean..........saw him on the today show this morning.

Spoke well but lied through his teeth about the leadership challenge.

Maybe Labor can recycle him again ???? They are all for a cleaner substainable Australia........recycling is great for the climate ;)
