Its interesting, Gillard and many ALP supporters have been screaming about how bad it is that Tony Abbott wont stop attacking them - then they cop a massive King Hit from the Greens in the form of their Malaysian solution being blown out of the water, Abbott has nothing to do with this high court challenge, yet reaps the benefit of GIllard being painted as weak and ineffectual!
What can she do? if she accepts it to appease the left and then its the situation with many swing voters of Beazley and the Tampa all over again, challenge it and again face the wrath of the Left. Abbott must be just about wetting himself right now!

I would concede that the actual Greens party did not initiate the challenge, yet its fairly obvious that their supporters did! Either way I am sure if we go and ask Lee Rhiannon or anyone else in the Greens how they felt about the challenge and the outcome of it they would be very much pleased over it and embracing it as something they give endorsement as a group towards.
As to the actual issue of Boat People there are two things that stick out to me, one is how dangerous the trips are and how many people have died tragically making the trips, no one opposes refugees coming to Australia, I would hope that no one endorses the boat trips to get here and I dont feel that is clear enough from many supporters of refugees.
The Second issue where Gillard can immediantly change things is to go and deal with issues that cause people to become refugees and including if its simply as an economic refugee. Take the "Fair Trade" industry and specifically in areas of Africa where many refugees originate from. All it takes is for Gillard to have the courage to put a bill through the parliament banning outright the sale of non fair trade coffee and chocolate in Australia. The result is that people in those areas of Africa suddenly get fair wages, education and the things they need to have a fair go as contrasted to the conditions of slavery that they currently work under. If Gillard or Abbott are serious about stopping the boats then it needs to start here. The Liberals have already had a fair trade bill relating to vending machines in parliament house knocked back by the ALP, I would suggest that the ball lies squarely in Gillards court and she needs to stand up and take action over it if the problem is to be dealt with.
