Postby jake the snake » Wed Mar 03, 2010 4:58 pm

a mate of mine works retail, im pretty sure they are underpaid

not only are they a retail assistent but also stock manager and dresses the windows etc.

they signed a contract, but im pretty sure workplace agreements were scrapped and that the AWARD rate must be paid. is this correct?

the company is a national company but only has the one sa store...

they are paid about 15.50 an hour but according to me should be atleast 17.09

good ? i also work in retail i am salary not wages
how old is your mate? if under 21 thats about the right pay rate if over 21 should be around $17.90 per hour.
my suggestion to your mate is discreetly ask those that do the pays to confirm what the contract and e.b.a. stipulate if he is being ripped off he should persue back pay.

can also ring workplace ombudsman or fwa.gov.au

to find his award and what rates he should be on under the award and then find out what agreement he is on.

I do believe that wages are now supposed to be AWARD based as the AWA's have been scrapped but there are still people working under an EBA.

In the current AWARD there are provisions for an agreement to be made, but the employee can not be worse off.

AWA's remain in place until their nominal expiry date, some employers signed employees up for 5 year deals in November 2007 so they still have some way to go. Not all did that but there are still many people on AWA's out there.

Jake the snake. try these people http://www.sda.com.au/ they should be able to give you the advice if your mate is being underpaid and can act on his behalf if an underpayment claim can be made.

Decades ago I was a shop assistant but found it hard to nail down the correct hourly rate .As they had lots of different awards .Turned out my employer was under paying us !!

EBA's are still in affect.Ours expires this year and the workers are planning on the next one already .
