We've only seen one photo. A smart lawyer would argue that whilst it proves they were "at the scene" it doesn't prove what is alleged to have occurred. That's why video footage and CCTV are much more helpful.
Likewise, you can also take a photo or video if you are simply suspicious. For example, if you see someone photographing a bank or loitering outside a school. If something transpires, you can pass it on then.
