We've come to the agreement in regard to the evaluation of the house.. Would like a bit more, but there is no point, cause if I got another evaluation it's pointless and I just wanna get it done.. We ain't going after each others super or anything and we are keeping it pretty straight forward.

Another question, as I said she is paying me out of the house and she is saying we should go halves in the fees, should that be the case if she is buying me out of the house?


If she is staying in the house she should pay all the fees for transfer of ownership etc. it will be added on to her new mortgage amount.

Why should you pay fees on something that isn’t yours?

I did it the other way around and kept the house (not married but house was in joint names) I paid all the fees as the house was now my responsibility

There is no such thing as 50/50 care according to the authorities, it is bizarre, their level of care breakdowns are bullshit.

well that's odd... We aren't contesting custody or any other financial issue. Just the house, which we agree on. The divorce papers say that we have joint custody.

That's the main thing. I had to go whole hog as I didn't want to get taken for a ride and I was having my kids the majority of the time.

I just got of the phone to the bank and the only fee I should be charged is me breaking a loan... But it doesn't seem to be much.

From a bank perspective there will be a discharge fee of around $160 (government fee) and maybe a bank fee of around $350, presuming loan is in joint names then you should just split that.

She will have similar costs to lodge a new mortgage and title in her name solely, you shouldn't pay for that, that is what she needs to pay to get her affairs in order.

Thanks mate and everyone who has helped.

But apparently the financial divorce is apparently different according to her (just spoke to her). It's so if one of us come into money down the track we can't claim anything against them, apparently just the divorce doesn't cover that. I have zero interest in that but she claims she wants to cover it....

I didn't know it was a thing and I thought the divorce covers all that cause we don't have any legal obligation to it

That's what happened to a mate at work. He 'divorced' his ex 20 years ago and a couple of years ago she went him for the financial divorce and claimed another $30k from him

probably :shock: :lol: even then it's not my money!!! When you try and take money from each other, I think it's a disaster especially when kids are involved... I just wanna sort this out
