I think the price he is paying is too great here.

Some get drunk, run someone over and get a suspended sentance and a good behavoir bond.

Why is Australia making an example of this young man..? :shock:

Does the punishment fit the crime? He got a suspended sentence from the courts, fair enough, he missed the Olympics, probably fair enought oo. But if he's allowed to walk around the streets freely, he can't be that dangerous to society can he? And someone correct me if I'm wrong as I didn't see the story, but didn't Cowley slap him first?

Let the guy compete. The courts say he's OK to be part of the general community (at the moment anyway), surely Swimming Australia could agree with the legal system.

I know very little about the facts, but if he has been punished by the courts and he has missed the Olympics and has kept a clean record since the incident then I think it is time to let it pass.
It makes me think of the situation where you have a kid at school, who gets a week's detention from his headmaster, and when that's finished he has to do another week for his home room teacher. My point being the punishment should be in proportion to the crime and not measured by the number of people who hold sway over aspects of one's life.

This is how I understand what happened (obviously this is not pure fact) this is what I invisgaed after hearing both sides of the story.

Ammon Sullivan and Simon cowley were hanging out after a few drinks after the olympic trials (party organised by thorpey) SC was talking to AS. AS wasnt drinking, he decided he wasn't going to drink and already start focussing on the Olympics. Nick DArcy came along and started heckling AS for not drinking and getting stuck into him, dragging him to the bar to buy him a drink.. SC who had never met ND, started sticking up for AS and defending his right not to drink. As ND left the scene, SC clipped him accross the back of the head (pretty lightly by the sounds) ND went back to his friends and returned fuming. As ND came to approach SC about the clip overe the ears, SC stood up and it was then ND gave him a massive roundhouse elbow which put SC quickly back in his seat. Nick Darcy has said he thought SC was going to hit him again as he got out of his seat, so he hit him first - Very hard in front of all the swimmers. SC said he cant remember the clip over the ears, yet a whole lot of people have given evidence saying this happened. I think SC should be honest about the original hit.

IMO ND has served his time in missing the olympics. That is HUGE punishment, although this was a severe assault.

He should have gone to gaol for GBH.
Even if the other guy did clip him first, which was wrong, the response was totally disproportionate in the degree of force applied.
