thats where the problem is, they are pulling over people doing the right thing also, new drivers dont have choice but to be on P-plates, its the only way to get your licence, does this really mean they should be constantly harrased? and does it mean they should automatically be considered a dangerous driver? simply becouse they are sticking to the standard way of getting your licence?

Got pinged by Mr Police Man on Motorbike the other day !!!

I will panit the seedy picture !!!

Sitting @ a set of traffic lights waiting for the lights to go green - took my mobile phone out of my pocket to put it on my car charger whilst at the traffic lights - The lights turn green then I proceed and then with in 100 metres I get Mr Police Man Turn his siren and lights on and point for me to pull over - I sat in my car and waited for him to come to me and he asks ( please get out of your car sir )

I ask what the problem was and he then explains to me that he saw me have my mobile phone in my hand whist at the traffic lights and that I will be getting a fine and losing demerit points for use of a mobile phone whilst in a motor car - I firstly pissed myself laughing - then I asked did you see what I was doing with my phone

He told me point blank that he saw me take the phone out of my pocket and put in on my car charger and that i broke the law by having my mobile phone in my hand whilst being in use of a motor car - I then pissed myself laughing again and explained that he couldnt be serious - He then explained i best shut up or else he will go over my car with a fine tooth comb.

I thought then and there that he was not going to change his mind and that he was obviously on some sort of fund raising exercise and that this would be better sorted out later.

So the next day I touched base with my lawyer and he explained that in real terms that i had been in breach of use of a mobile telephone whist being in use of a motor vehicle ( harsh but true ).

So the morale of the story is dont touch your phone at all in your car no matter what or you will be nearly $400 lighter in the pocket and you will lose 3 demerit points !!!

I always laugh when i hear the "official line" of "designed to save lives" when discussing matters such as your one Blue Boy. Absoulutely ridiculous waste of resourcing that could be far better utilised on something else. $400 bucks for putting you phone on charge while sitting stationary at the lights :roll: Glad the public is being kept safe from the likes of you :wink:

Perhaps getting somewhat off track here, but I listened to an interesting debate between some friends the other day, over whether it is reasonable to enforce a driver to wear a seat belt.

One friend claimed absolutely, and that all statistics prove the seat belt greatly reduces the extent of injury and incidences of death, in a vehicle accident.

The other friend, steadfastly refuses to wear one as he has both family and friend, who were thrown from vehicles and would ultimately have ended up dead had they been wearing them ... This friend also claimed that by wearing or not wearing a selt belt it wouldn't harm another so it should be his choice as to whether he wears one or not, particularly when there are thousands of commuter passengers a day who travel without wearing one.

I didn't get into the debate because I ALWAYS wear a seat belt as standard practice/habit, but I thought my mate debating his right to not wear one had some interesting points.

Anyway, enough of my BS, may regular transmission resume! :D

Yes you WERE technically in breach but I swear, you could easily challenge that in a court of law.

As far as I'm concerned, the phone is an inanimate object until it's on, or being used "as a phone".

You can take out a packet of cigarettes, a lighter... focus your eyes downwards whilst you light it, open the window and continue driving ok, but putting a phone from one place to other is illegal.

Spot on Dissident. Quite staggering that you can get pinged for putting a phone on charged whilst the car is stationary but fumbling around lighting a smoke whilst the car is in motion is acceptable.

Not according to the regular Policeman they have on 5AA each (Paul someone maybe) ... I heard someone call in some time ago and complain once, and I'm sure he said something along the lines of "Unfortunately, you can't really touch your phone at any time, even if the vehicle is stationary at lights or parked with motor running" ... He seemed quite sympathetic to the caller, but said that by the letter of the law you basically couldn't be seen to handle it at all.

We looked in to fighting it and yes I really wanted to but as you said I was technically wrong - but it still sux big time :evil:

You may be able to persuade a magistrate that the charge is trivial even though it is a technical breach of the law and have him or her throw it out and berate the cops for wasting the court's time by bringing the matter to court. However, you would need to run that approach by the Police Commissioner first, and possible by your state MP to be able to demonstrate to the court that you tried to get them not to waste the court's valuable time. With the Magistrate it would be a matter of luck which one you got and how you presented [as a well groomed polite young man] and how you made your case - very respectfully!

Perhaps you could also pressure the MP to get the law amended to say "using" a mobile phone is the offence. Perhaps the RAA might ake that up too.

is a site that lists recent deaths of people with myspace accounts... check out the forum section much talk about young peoples dying from being thrown from vehicles (not wearing restraints) where all other occupants have survived - they attribute this to the wearing of seat belts .. i do agree it should be a personal choice however after a lot of research on the topic.. i have decided to wear my seatbelts as the law dictates - of course should also stop me hitting the windscreen should a collision occur and honestly after speaking with some CFS dudes who attend crashes far too regularly they tell me there is nothing worse than arriving at the scene seeing someone deceased half in, half out the vechile.... so seatbelts for me too!

So does that mean when they tell you to pull over and take the call, then you have to turn off the motor aswell ?!?!?

I saw one very talented :roll: woman on the way home from work the other night, she was able to turn from Henley Beach Rd onto Holbrooks Rd using her elbows to steer while she had her phone jammed between her ear and elbow, and also using both hands to light a smoke.......she's the one that should have been pinched. :evil:

I ride a motorbike every day, and the last 2 times I've nearly been cleaned up....the other prick was on his mobile. :evil: :x
