MY PARKING FINE what shall I do ?

Postby mal » Tue Aug 28, 2007 3:19 pm

I recieved a parking fine for $52 for parking on the yellow lines
The fine is due today
I went to a library on the notice to pay the fine

Being a smartarse I took
1x $20
2x $2 coins
$28 WORTH OF 5 CENT PIECES BAGGED IN 14 X $2 BAGS

This was presented to the male cashier
He then told me I could only pay a maximum of $5 of 5c pieces to pay the fine
I said there is nowhere on my infringement notice about paying in 5c pieces
He told me to go to a bank
I refused

I then asked for a form to declare of my intentions not to pay the fine
I wrote on the form I had a vehicle problem
I did this as the fine had to be paid today

Can I use a vehicle breakdown for an excuse ?
Is it true I cant pay in more than $5 in 5c pieces ?
Will I incur a further fine ? or will the notice I filled out exempt me until further notice ?

What shall I do ?

Legal tender is legal tender. If they are too lazy to count it, I am sure it is their problem and not yours.

mal,

I'd hate to break it to you but the cashier is right.

according to the RBA website:

* not exceeding 20c if 1c and/or 2c coins are offered (however, it should be noted that these coins have been withdrawn from circulation but are still legal tender);
* not exceeding $5 if any of 5c, 10c, 20c and 50c coins are offered;
* not exceeding 10 times the face value if coins in the range 50c to $10 inclusive are offered; and
* to any value if coins of value greater than $10 are offered.

sucked in smarty pants, no, they do not have to take it! hehehehehehe  in all seriousness to avoid further fines (filling out the form will not give you extra time and they never waive 'em anyway) go to the bank yourself and change the money pay the fine and move on Mal.. there is more in life to worry yourself over... :?

I phoned the council and now the form has been filled out its
frozen all activity for 2-3 weeks and the notice will be assessed
Ive given an excuse for parking over the yellow lines so I wonder
if I have any chance to get the Ticket wavered ?

I wonder what coinage I can legally take in next time  ?

Yes that is a law
The law is they DONT have to accept the $28 in 5c pieces
BUT
Does it mean they CAN also accept it ?

I think you will find Mal that they CAN accept it, but to be difficult, as I suspect you may have been trying to be to them, they will refuse to accept it... i know my council uses the legal tender argument also

I had the 5c pieces bagged for a while
I was going to take the bags to the bank, but thought nah I will
use it to pay the fine instead[and be a smartarse as well I must confess]
And I get out of the inconvienience of going to the bank.
It was prankish BUT it is still legal tender

LUNCHCUTTER
It is not who is legally right or wrong the council wins 100% in that regard
Its now a matter of principle
I accepted the fine, I went to pay the fine, they refused my payment.
Morally I think I have set a precedent

Its now the little guy vrs the big guys

MAL that's the issue - to my knowledge, 28 bucks worth of 5c pieces is NOT legal tender and by law any body/agency can refuse to accept - also Mal if you were to take the 28 bucks worth of 5c pieces to your bank, Im pretty sure most of them will charge to a percentage to count/weigh/check etc

good luck with your fight - i wish you the best of british.

MAL probably went to the bank on the way and cashed a $50 note

You should have done a payment plan - $5 at one library, $5 at the next library, etc. Do it all on one day and they will spend a week reconciling it. :D

The other option could have been the one used at servos when people get caught short of cash - leave them the spare tyre!

Mind you $52 seems pretty expensive for parking OVER yellow lines as opposed to parking along yellow lines.

Maybe you could give them a winning betting ticket MAL?

the holdfast bay council took from memory about $60.00 in 20c pieces off me when i got a ticket argued my case in a letter (i was doing a delivery in my own car on my way home from work & parked in a loading zone, which is fine in a van) AS WE KNOW REVENUE RAISING, anyway i went in on the last day & paid in bagged 20 cent pieces & it was accepted, i did say i had to go to the money box where as in actual fact i went to the bank & got it in change
i thought secret groups were a thing of the past, well not on websites anyway

$28 worth of 5c coins

I'm expecting a parking fine soon. Picked up people from the airport the other day and it was busy. The car in front of me went over the pedestrian crossing and since there was a gap in people not walking across I followed. However, they stopped as soon as they went over without pulling into the side-park, popped their boot for the people they were picking up and I was stuck on the pedestrian crossing! The people I was picking up saw me so threw their bags on the back seat and hopped in. Meanwhile along comes a parking inspector so I zipped off as soon as I could, but saw him writing down my number plate in my rear view mirror.

Aerie

if the airport decide to give you a fine, blame the guys that are supposed to deal with traffic management - they are the lazy pricks in the yellow tops who walk around and do absolutely jack shite, but think they are it!!!!

Everyone wants to know where mal got the $28 of 5c from, well remember the break in at Arkaba, the smart people got away with the gold coins and Mal got left with the silver!!!

Legally they can, they may have a internal policy that says they can't, or they may just be sick of counting every 2nd person who walks through the doors 5c pieces.
