Try having a useless lump work for you who does the following:

1: Refuse to do assigned tasks
2: Has 40 minute lunch breaks go for up to 90 minutes
3: Arrives at work up to 20 minutes late on a regular basis
4: Regularly 'flips' out and abuses other staff, claiming many are racist

then get a Union official warn you and your senior managment that an unfair dismissal case would follow any sacking.....no wonder I left the place.

Sounds like a guy i used to work with ;)

You have to wonder in such instances whether references are checked and the person is given a throrough appraisal before being hired..

You've just described 1 of my former supervisors, it's just a pity that the public service doesn't allow us to sack underperforming bosses, instead they move them on, often promoting them.

Other than #4, where you would have to cover all bases, the rest should have been pretty straight forward.

I was a shop steward representing an indigeonous Aussie about 15 years ago When he was a temp, top bloke and worked like a trojan, as soon as he was made permanent........

It took double the normal number of written warnings, plenty of councilling, lot's advice from the Union, myself and other workers, but even the Union said in the end, "you've got to want to help yourself if you want our help"

He was the first person I saw sacked from the public service, if it can happen there without unfair dismissal claims, it can happen in private enterprise, you just have to make sure that you have all the t's crossed, all the i's dotted, and a very accountable record of all that has taken place leading up to the dismissal.

This was within a private company that covered a function the Government outsourced.
So it was in a Public Hospital, but not in the public sector.
