So it's taken him 3 years to get around to suing them ?

Court documents alleged security guards were negligent because they allowed uninvited bikies into the venue and were not manning exit points when the crows spilled out of the room.

If part of the problem was 'crows' spilling out of the room perhaps he could sue the AFL too.

Don't most people announce their intention to sue fairly soon after the event and then the legal wheels start to turn...albeit slowly.

Anyway surely it's the bikies he should be suing.

If I was on the door at a function and a gang waived guns/baseball bats in my face...I'd let 'em in.

$40k is almost worth paying just to avoid the litigation. My tip is they'll settle at $28k.

if the sanfl lose the case perhaps it'll have to change to aflsa so the afl can pay the 'damage'

*It may have taken a couple of years to find a law firm to take it on on a "no win no fee" basis, or who would take it on at all.
**You can never establish that bikies have money, so you sue someone who'll pay up rather than go to court, and who won't come round looking for you in the meantime!

The firm has that obligation, but I'm sure the Union concerned would say the worker on the gate could exercise discretion in the name of safety. However, you would expect he would then advise his employer, who could once inform or liaise with the venue management about whether they wished to contact the police.

There a several nexus points where this could break down.
