The answer to this is very simple.... it is illegal under the laws set by the Federal Government. During the transition to Digital Signal they have a very valid reason for doing this is that not every in has access to the full range of Digital Channels and therefore disadvantaging them and their viewing choice.
One would suspect in 2013 when everyone is on Digital then these prohibitive measures are removed and it works like how you suggest. But by then I bet the commercial channels have found a new way to screw the viewing public over
