Hi guys,

Just wondering if there is any one could help me out...

My ex and I are going through a divorce now, which is fine. But she has suggested that we get a financially separated too (non issue either). It could cost us 3-4K to get done (legal fees). Which I am opposed too as I don’t wanna spend the coin on it. Can anyone suggest a cheaper and easier way to do?

She is also paying me out on the house. But according to her that can’t happen til we are financially separated. Is that true or nonsense? I was under the impression she just needs to refinance the home loan into her name and pay me out. Obviously there would be fees to do that but I am unsure why we need to be financially separated to pay me out?? Other people haven’t even heard of that

I hope that makes sense, I am not good at this sort of stuff so any help would be greatly appreciated.

I wasn't married but we had a house together.
I bought her out and had a lawyer mate do a Deed of Settlement, basically stating that this is the agreed settlement and that she has no rights to anything to do with the house or its future increase of value, etc.
Cost me $500 cash

After seeing a mate at works ex wife take him for $30k 20 years after their divorce, I would do it mate. This was due to no financial separation...

A financial separation is very common where there is joint ownership of property (typically a house) and where both parties agree to the terms. There is a lot to consider at this time that some people overlook, both from an asset perspective (such as superannuation) and from a liability perspective (such as business ventures, outstanding credit/loan debts). There is plenty of reading on the website.

there is a do it yourself kit for it or we can go through with a solicitor. What do you recommend?

I'm not familiar with the laws, or the process, but my first thought would be to engage a solicitor.

I would not advise you one way or another as I do not know your personal situation. If your ex is adamant that a solicitor must be involved then, as a suggestion, try doing it yourselves and then have a solicitor (perhaps legal aid) check it. It's a bit of both I know but your and your ex's financial welfare will both impact the welfare of your children.

We are amicable, and our only interest is the kids welfare. Hence why we want to keep it simple... She has gone to a solicitor and said she is happy to get something written up which covers everything. And it won't be lodged until ive seen it and given it the ok...
I truly believe she doesn't wanna dog me, but there is a part of me that is doubtful...
