Double Parking

Question.

At the school pick up today I was cruising for a park, I stopped at the crossing as the "crossing monitors" had arrived, and I stopped to let them cross and set up flags etc, in the mean time, my wife jumped out of the car, and left me to find a park.

I noticed about 50 metres ahead of me a Council Parking inspector taking my cars photo. After I parked my car I asked his what he was taking a photo of my car for and said to issue a fine for double parking.

I call bullshit as I wasn't parked, and I had stopped at a crossing whilst kids were there.

He left as I was walking out of school and I saw him park illegally behind my car and he took more photos car despite being parked in a proper area.

Thoughts? Locky?

Don't allow youeself to be put in a situation where you could be breaking the law.

Break the law and you will be fined. :D

Yes it sucks.

But it may cost more to defend yourself that the fine is worth. :(

Surely if the driver is in the car and the car is running it isn't parked?

That's my view. He also took a photo of my car whilst it was parked legally. Going to ring the council about that as there was no reason for taking a photo of my car whilst it was parked legally.

Write a letter. Don't get emotive. Just state facts - you stopped at a crossing legally, waited for crossing monitors to cross and moved on and how long you were parked there.
Add that he was parked illegally to take more photos of your car - it won't get you off but it adds weight to your argument.
You can also point out not only the illegality but the breach of council's OH&S rules.
Ask to see the photo of proof that you were illegally parked. If they won't email it to you, tell them you'll go into council to see it.
Take a photo on your camera off their screen if they won't give it to you.

That's all the advice I can really give. I had a secret weapon that probably got me off mine rather than the letter (I can tell you that via PM).

Good luck, as all bureaucracies are belligerent when it comes to revenue.

Re stopping at the crossing, there were the school monitors, I stopped to allow them to cross the road. The fact they didn't and waved me on after my wife left the car surely doesn't mean I parked. If they weren't at the crossing I would've driven through and continued to a park...

Also as I was walking back out of school the council bloke saw me coming and yelled in my direction "the fine will be in the mail".

What is with that?

No idea. Get the photo and then dispute the fine. Sounds like you were standing and not parked. That is another way to have it withdrawn, if it has the incorrect offence listed. Double parking at schools is a problem and dangerous. What normally happens is parents fill the pick up zone, other parents pull up next to them and call out to their kids to get in. Doesnt even sound like there were cars parked inside u. Sounds like you just stopped at a crossing as required and your wife got out whilst u were stopped. If this is the case then there is no offence.

Just a word of warning IF you end up paying the fine
Some councils will not accept 5, 10, 20, 50 cent pieces as payment
