Anyone know if your employed but not getting paid and sick/injured can you get sickness benefits from centre link
Been two weeks no money so im still employed cant work again yet

Correct me if I am wrong, the reason you cannot work at the moment is due to an injury incurred whilst at work.
It was a work function, but I believe under workcover legislation, that is also classified as work.
I would be calling workcover and trying to get this sorted out ASAP.
You should be getting paid, even though you are not working, as your injury happened whilst at work.

That's where the lawyer comes into it. Workplace law, with what is and what isn't deemed a workplace related matter have changed over time and I'd imagine would be a specialist field.

We have someone on Workcover here.

Our company pays the employee, and Workcover reimburses the company.

As ive said but ill say it again lol its cool
October the 21st i attended an awards dinner sober i went to the toilet where a toilet door hit the right side of my face and then the floor hit the ride side of the back of my head .
Now my boss came picked my kids up took them to be with me '
they were told i may die .
I only recall day 11 when i was sent to rehab 12 days later i was sent home .
i was told it would be three months before i saw the doc . have seen two specialists at the hospital
Basically day 1 home work started calling me and saying come back on light duties they didnt like me saying how long before i see a doctor and have to see specialists . did say go on sick leave to see a doc.
Work cover tried to give me money but if they say no pay it back .
So basically doctors are saying workcover including the rehab doc who sent my employer a letter saying im on work cover due to a traumatic head brain injury at a work function
So move forward
I have sent my employer forms saying im on work cover
insurer contacted my lawyer by letter and say ive been sent one no im not it was a function i had to attend i wasnt invited . but i said the office worker walked around asking if we would go
They and my employer are saying its not work related and i have a preexisting condition Diabetes
My lawyer is saying correctly its not my diabetes
Funny ive only worked there for 21 years

Micky, my mates work in Centrelink and I'm self employed. I'm damn sure you can only get Centrelink benefits after being on sick leave without pay for 12 weeks continuously. But the website doesn't actually state there is a waiting period.

I got paid let me think
1 week sick leave
2 week annual leave
3 week long service leave
4 RDO leave
5 the last two weeks I've been paid 79 cents each week to super
From their first phone call work kept saying go on sickness benefits
Guess I'll find out thanks for the help guys
I know I don't trust employers
Funny they paid a co worker work cover for cutting his hand open to n a lunch break opening a tin of baked beans

I also think you will be re-imbursed the sick leave and annual leave you have been paid out once your lawyer sorts out the insurer and your dodgy company!


as for centrelink, Im not sure.

My understanding once you get a yes they do no idea for no .
Except my employer says come back now on light duties . Main reason 6 co workers left after I got my injury

and as your lawyer will probably be informing you, along with your union rep, I wouldn't be going back to do any duties until you get all this sorted out!

Not yet but I'm still off it could be for awhile
When I went back in pain last week day four of awful head pain .
Getting accepted in the girl was saying 12 months
Imagine if it takes me that long
Guess it could
Pain doesn't stop unless I take meds and they wear off
Pain keeps going on

I guess that with the injury you suffered it will be time that hopefully heals all these wounds.....but hopefully sooner rather than later.

You may have insurance under your Superannuation plan.

Maybe seek legal advice Mickyj.

When I had my heart attack I should have looked into my super.

I was off 17 weeks and my sick leave paid for it.

When your down, you miss things.

Now I have built it all back to where it was, now my company is trying to make me take some of my accumulated annual leave.

I tell them, why don't you make me take my sick leave, lol

I get out of bed and go to work. It's habit.

Thanks done that I can only get a payment from my super if I get on disability no insurance bugger
