Look after yourself mate, that's the most important thing.

The system can be a difficult one to deal with at times, very difficult, but keep doing what the doctors and specialists tell you.

Did you overhear my work calling me after they've been told by therapists not to call me as its to stressful
Ok she was saying the insurer won't decide for another two days . I said who so they lied to my lawyer that I'd get paperwork on xmasday 2015 .
Oh you have a lawyer now yes and he's advised me not to be on benefits until the insurer says no ,
Oh but we want you to get money we aren't paying you but if they say yes I have to pay it back
But your getting no money I know 79 cents into my super
So she said you better ask therapists if they have a pyhscologist!!
Which I've done also told work I was back in hospital last week


But my god they aren't chasing their insurer I kept saying if they say no I'd go on benefits
No they want me back fit and healthy but not chase their insurer
It's ok I've told the lawyer they called and what she said
Yes the lawyer knows I'm under stress

My taste yep still can't taste anything smells not good
My first meal out of hampstead rehab after the RAH was Mexican I ate the chillis everything
Couldn't taste a thing lol
Depends on who I speak to young head victim said 4 weeks been longer now therapists said could be longer
My lawyer said may never get it back
Can say lawyer told you know who I had one didn't go over well lol

No to workcover my lawyer got the letter but i didnt
If i go back to work at present ill fall over work doesnt get that

Do feel like im getting a bums rush
Does raise the question which my union just answered for me
No pay for the last two weeks am i still employed by this company
Union says yes

Just a quick update
I have not got offical paperwork from insurer but seems it's no to workcover
My lawyer is started to take action .
I'm getting there slowly still head spins eye spins
Near falls three before today and one bad step when walking with a therapist
I can't drive to sound like a redneck govt took my car license away lol
And my main therapist said no way can I get on a forklift and drive it .
Not sure when I return to work gotta go see my GP in a couple of weeks

Funny not haha insurer keeps sending me an email they have helped get me back to work please fill in survey
WTF they can't send me the letter texwirk cover

Just a quick medical update
Finally my therapists got me into see the rehab doc . Yep finally have medical Certs for three months well started October 21
I do have to see two different eye doctors one next week the other one takes 6 months to get in .
Interesting that it will take me if I'm lucky up to 2 years to be back to normal.
Hopefully I'll be great to make it to the footy
There are issues going on that my lawyer and social worker are handling different issues for each .
Funniest thing got a large bill from the RAH due to allied health helping me instructions were send it to workcover. Had to get social worker handle it and let them know not work cover . Seems the person at work responsible is on leave .
Which raises the question these say it's workcover , doctor, lawyer , union , RAH , social worker .
These say it's not employer and insurer.
But trying to get written proof from employer and insurer seems that's like finding the holy grail lol .

My experience dates to the 1990s, but treating doctors can say whether it meets WorkCover criteria in their opinion and issue a certificate stating so.

Employers and Insurers usually deny it and fish around trying to get independent medical reviewers to support them and dispute that it meets the criteria.
I think "independent " should be in quotes - they are supposed to be independent but some who are dependent for a large part of their income on insurer referrals can become biased - sometimes knowingly sometimes unconsciously...

In the end the Industrial Court is the only place to make a final decision after the lawyers have battled it out, but reasonably often the lawyers manage to reach a negotiated settlement and save actually going to court.

Let's just say in the past I've been a couple of times I've been on work cover for this employer .
Not permitted to see my GP sent to let's call them work cover doctors . Everytime myself or coworkers sent there you are returned to straight to work on light duties . Last time I got better with an injury kept doing the light duties off to see this doctor oh you need more X-rays a specialist I was saying it's better no no . The workcover physio same building looks at me your better yes I said but the doctor won't listen he set him straight .
Let's just say I was surprised to be sent in an ambulance to the Royal Adelaide and not to that workcover lot .
Very glad I was .
And yes I understand there's a battle going on over workcover
But I know what's been said to my lawyer
I still find it funny ( not haha) I was on my death bed my employer sends the insurer a letter saying I won't make a work cover claim .
Thank fully I lived does raise the question at a work function sober you have an accident or in my case a traumatic brain injury you die who is at fault .
By the sounds of it not my employer

Yep finally got a certificate from the rehab doctor she asked do you want me to put exactly what's wrong .
Took zero seconds to say yes .
I was almost dead they need to know what happened
And the employer and insurer say
A diabetes
B drunk
A hasn't been an issue for 2 years yes I check my sugars and take meds 3 times a day
B I had one drink of booze in 2014 does that make me drunk in 2015

I don't think they can actually stop you going to see your own GP or being referred as necessary to a specialist your GP recommends.

They certainly couldn't in the 1990s, and it would be shonky for a government to legislate to restrict your freedom of choice in seeking fully independent medical advice. However, private GPs and specialists may not be prepared to accept whatever WorkCover will pay as full payment - I got out of it once they reduced what they would pay for reports below the value of the time required to do them.**

(They have to be carefully done, with every I dotted and every T crossed because you may finish up being quizzed on what you have said in the report in court.)

People used to pay as they went, and reimburse Medicare out of the settlement once the WorkCover claim was settled, and lawyers used to factor this into their calculations, or, some doctors would wait up to two years for payment at an agreed higher fee - until the state government changed the WorkCover legislation and made that illegal.

In the end if WorkCover and the government can restrict you to seeing their "approved" doctors they can (to some extent) hope to bias the outcome.

** A year or two later WorkCover were writing to medical colleges asking why many private specialists would not see WorkCover patients at all.

However, I'm not sure what the current situation is.

You could be correct these injuries not my current one have occurred while on the work floor .
Someone takes you to I can't name them so let's say work cover doctor . You are examined and told what's wrong sent back to work and told by this doctor your on light duties .
This employer of mine had a way of getting you to do what they want .
I've heard some on workcover there in the past they would be docked if their WC appointments are during work time . This lot arent in a union .

Hence in my case I heard
A the insurer saying they determine when you return to work not a doctor .
When I heard this I called my union straight away and was directed to my lawyer . Union said no insurer can say when you return only a doctor can .
B Both my employer and insurer have both told me my diabetes had caused my fall or both of my hits to my head front and back .
My diabetes hasn't been high in two years
C written report by employer I was drunk
I don't drink
Paramedics took blood I was sober
D my employer never contacted me in hospital or rehab . They were sent a letter by rehab doctors backing me on workcover . I know this my employer have my mum ( no idea why my mum ) mail re me .
Why write a drunk report on a non drinker
E why wait until week 1 out of rehab and hospital and say yes the diabetes
But they started if you don't work on light duties no money go on sickness benefits.
Week one out from a month in hospital and rehab why wait
And why does the insurer send a letter when I'm out week 1 we will give you money if we decide no you pay back ,
Lots of questions including my employer sent the insurer a letter saying I won't make a work cover claim ,
Also work is saying I didn't need to be there no work cover .
Funny situation if it was a work Xmas party I would have been put on work cover .
No idea what is different

I should add
October 21
I sustained a traumatic brain injury
This injury I had fractures brain bruising brain bleeding.
As a result I have PTA I can not recall anything of October 21
That includes being at work for 8 hours catching a taxi to the convention centre
How the hell a toilet door hit my face and the toilet floor hit the back of my head .
Both on the right side
As long with fractures bleeding PTA I also have a bubble behind my right ear drum . And I was told the other week in the ED at RAH a bubble in the sinus.
There is also an issue with my sight have to see two eye specialists . They will also determine if I get my car license back .
Plus I'm suffering from head pain light headedness and when I lay down my eyes roll .
And if I bend down get dizzy .

So would anyone rush back to work on light duties cause I may fall to the ground
