Speaking of cheques.. I got a random bank cheque before Christmas for $50 for an over payment on a home loan I had with my ex like 10yrs ago. :shock:

Was made out to both of us as it was a joint loan at the time.. do we both need to be present at the bank to redeem? :?

Cause the cheque still needs to be honoured by the other bank.

Simple answer is to get whoever owes you $ to pay direct to your bank account, not by cheque.

Well it used to be 5 days, its really only 2 days, deposit Monday you can access it 1st thing Wednesday.

No use putting in new processes for something that will stop very shortly.

Good question, however I presume that would have to sell it based on their being a lease in place, therefore whoever buys it has to honour the lease term. Which in turn makes the property less marketable as it rules out owner occupiers.

I reckon there's a law about "vacant possession".

Ie - If the contract sale of the house is based on "vacant possession" the new owner can expect to have the home empty.

I think there's also a 30 day period where a landlord can ask you to vacate the property even with a lease in place.

South Australia

Landlords must provide tenants 14 days’ notice before they advertise the property for sale, and “reasonable notice” before each inspection. They must also specify a time between 8am and 8pm, on any day other than a Sunday or public holiday, and cannot conduct more than two viewings every seven days, unless the tenant gives them permission to do so.

Neither the new or old landlord can evict the tenant if a fixed agreement is in place, unless the tenant violates the terms of the lease, or the two parties reach an agreement by mutual consent.

If the agreement is periodic, landlords can evict tenants on 60 days’ written notice if a contract of sale has been signed; on 90 days’ notice, if a contract hasn’t been signed.

Thanks guys, just got a call, got a meeting with the agent tomorrow, will try to use the situation to our advantage as my tomato's and zucchini's are booming.

The wife is peaking already but I don't really care as I hate the house.

By the look of it, if you've got a 12 month lease in place the owner can't, nor can the new owner, kick you out unless you agree to it.

I'd be thinking 3 months rent as compensation might be in order. ;)

Yeah, we're booked in until December, at a guess an investor would buy it, it's a nice looking joint but poorly designed, it's an absolute sauna given where the aircon is located and the direction of the house vs the afternoon sun.

A lot of young families live around the neighbourhood.

Heading up for the day this Friday, probably looking for a good spot to have lunch and check out some wineries/brewery.

Was going to stay the night, but now going to head to Pt Hughes for the free bed up there.
