No but technically you can cut down that part of the tree because it's on your property. (or pinch any fruit from it that's hanging over the fence)

However, if said tree fell down onto your roof, he would be completely liable.

In fact, IIRC, you are obliged to give them back to him as they are his property.
Also, I think you can only cut them back to the fence line.
