Thought you could only get it paid out if you leave the employer?

In writing. Send him an email stating your request, from the very start of the process I would be having it all in writing.

My idea would be send the email, put some nice wording at the end along the lines of "Thank you for taking the time to consider this, I look forward to discussing this matter with you in more detail at a time convenient to us both".

Via email, so it is documented, tell him that you are suffering from financial hardship through a personal matter that you don't feel comfortable sharing.

Looks like you're right :

http://www.fairwork.gov.au/leave/long-s ... vice-leave

Long service leave usually can't be cashed out while the employee is still working for the business.

However, some employers may see this as an opportunity to reduce the over heads they have, ie the long service leave they owe you.

Depends on the integrity of the manager.

I was offered any assistance in this regard when I left my wife, fortunately I scraped through and now have 3 months to go for my 10 year anniversary since coming back here.

I've talked to the accounts lady, who says you are allowed to cash out after 7 years, but it's completely up to the boss if he wants to do it or not.

Here's what I found for SA.

There's zero chance of me taking my long service as a holiday, because we're in a two person office and the place falls apart. I was getting phone calls during the Super Bowl. They'd been open 3 hours without me and the place went to hell.

From Monday forward, the company will owe me long service if I leave. I just need a nice way of asking for it now.

Or a new job.

Looks like the terms used in those exerts are different. One notes you can cash out long service leave entitlements which, to me, reads after you 10 years. The other clearly terms pro-rata as something different to long service. ( Unless you leave ).

Do you have any annual leave you want to cash out?

I got told late last year I needed to take holidays. I'm currently just shy of 5 weeks.
So I've taken some days off here and there.

Can't see why you wouldn't be able to cash it in (I do in our business), unless the businesses cash flow isn't where they need it to be .. Employer reduces their liability, tax man gets his share, so wins from their end.

If you take the full amount, you'll lose close to half in tax.

EDIT: Employer can also benefit from paying out at your current salary rate rather than potentially an increased rate down the track.

A dude at my work took every Friday off for 65 weeks when he reached his LSL, smart move.

I'd be happy to part with $3k to take home $4k at the moment.

Currently underpaid as it is. As an Operations Manager (effectively the General Manager), I could make more working at Coles.

Just checked my balances.
As of June 1 I'll have 623 hours of A/L & LSL combined and 652 hours of sick leave, I might go drink some metho.
