So Centrelink no to sickness benefits
But Newstart incapacitated benefits

I have no clue
But life's like a box of chocolates

Newstart Allowance is only paid if you're only able to work 15-30 hours per week because of your permanent incapacity.
A condition is you look for work in that range.
If you can't work 15 hours per week you claim Disability Support Pension.
All are dependent on you no longer being employed.

I asked why not sickness benefits to this lady she said I would not have to look for work as it's permanent
As far as I know I've got a job that's another issue not sure for how long
And workcover kept coming up I should be on workcover but as I've said work and insurer say no .
I'm awaiting my lawyer and my social worker to call me
So I'll will ask about disability when I go there
Therapists are saying they will get me back to work
Work wants it now basically but need to know the hours what I can and can't do .
No one can tell work that I've given work work cover Certs not accepted I've given them a sickness cert from rehab doc until April 25
That I'm told isn't good enough they want the hours what I can do now .

But I'll ask Centrelink about disability
Honestly work calls are just Stress
Everyone from Centrelink doctors Union lawyers hell even the all mighty say it's work cover
But not work or their insurer

Thanks wedgie that was helpful

Sickness Benefit is for temporary issues, you need to provide Med certs and get reviews every 13 weeks. Disability Support Pension is for permanent disability with reviews less often.

Yep wedge everyone was supplied with work cover Certs
When that was denied I got a cert from rehab doc .
Unfortunately she wrote from October 21 2015 until April 25 2016
I sent a fax to the employer
But Centrelink refused to accept the date range could not get into a rehab doc .
GP write another one correct dat range
I'm seeing the rehab doc again in 3 months
First eye guy flinders vision in another 6 months
I have two more eye doctors opt something match 2
Neurosurgeon second appointment is March 3
ENT were asked for a quicker appointment my last trip to the ED
They've gone missing
Certificates I can get
My lawyer is waiting to be for certain it's permanent
Which cert said no idea
And I've been again to Centrelink supposed to get help my social worker and I had to do it on a computer thete that didn't work properly
My next appointment is on the phone at home social worker will be here .

Mean while my lawyer taking the insurer to tribunal starts this week .
Now I know why work had said what it was saying
And the insurer is still staying diabetes and me being drunk caused the accident
Even with a blood test by paramedics that showed zero booze and drugs
Hospital checked my diabetes normal sugars

Guess if that's all you got go in swinging

Just an update had my third Centrelink appointment today on the phone .
My social worker was here . Now I had a call last week I can't get sickness benefits as one of my certificates says permanent.
Ok but I can get incapacitated allowance .
But Centrelink idiot is going you need Newstart to find work social worker explained ok we had a form to fill out and send in my local branch will tell me yes or no . But she kept saying disability and had to be told I haven't been assessed enough for that .
Ok that ends social worker leaves .
5.15 my phone rings Michael this is such and such job placement ok why are you calling me .
Michael Centrelink made an appointment for you at 9 am today . Hang on I was just in a Centrelink appointment I've had a traumatic brain injury I can't work yet I have a job you need to talk to my social worker. Oh but you might do 15 hours a week umm I have a job I can't work yet you need to call my social worker gave him the number . Then says Centrelink have made this mistake and will call my social worker Monday .
I called them and left a message
So why are all these people including my employer going on about me working but can't accept I'm not fit enough yet .
Grr
You'd think ive been paid money
I got a part pay Dec 21 2015 then four weeks of 79 cents into my super . The same time my long service leave went to minus 1 something hour . Yet all I'm doing I'd seeing doctors and doing therapy
Suddenly I'm a bludger lmao

It's ok everyone has issues
Me I gotta get healthy forget to talk
When I return to work ( I'll say when) I have to learn not to talk .( neuropsychologist said no way )
And after telling my occupational therapist what I do at my job she just about had a fit
Time will tell .
It's all going to a tribunal that started Monday next time I have to be there ,
At this stage whatever happens I'm not getting wages not being paid which I still think I'm not employed but I am .
Centrelink hasn't got a clue that alone is like a mystery movie

But don't worry I'll get somewhere either back to my job or not .

OK just a quick update
I had my second neurosurgeon appointment and my therapists wanted my son to go in with me. To make sure I understood what he said (thats an issue for me)
1 ok my accident i asked what fractures my sinus behind my right ear right side of my head and back of my head,
2 i have been told before on my ED trip i have two bubbles now i know behind the ear bubble is liquid bubble in my sinus is air.
3 they have no clue what my pain is either nerve pain or pain from the fractures .
4 the light headedness and dizzyness is normal for my injury
5 I told him the pain is in certain areas on the right side all spot on and it starts when i open my eyes until i close them normal again
6 told him panadol lasts 30 mins endone lasts an hour or i mean to take pain away .
7 I also told him ive lost taste and smell he didnt believe so he did a smell test i closed my eyes and he shoved it in a students nose and my sons nose they both Im told winced , Me eyes closed nope could not smell a thing . After that he said smell and taste may be gone forever.
8 I asked about centrelink theyve been calling me needing to know things this guy said to early .
9 I said work is having issues with me not cleared to work I m told my therapists visited work refuses to move me to do other work . Also work is having issues with me having a gradual return a few hours a day . Work are saying 8 hours a day doing the job ive been doing for 21 years and no way i could be longer than 6 weeks to improve . Specialist told me today no way i can work 8 hours a day with manual labor and my therapists must take care of that .
At the end i was told its time to live my life as much as i can and work must come to terms with how I am .Could take from 2 to 3 years to get as good as i can get
So thank you every one
Next week i go to a tribunal
Who'd think a sober guy gets so badly hurt

Just a quick one
Ok that could be called Black Tuesday
Tribunal wasn't great lawyer was held up .
My medical records have issues GP released notes re my injury the legal lady was upset she is summoning all my medical records from her clinic not many there truthfully
And the Royal Adelaide is dragging its feet with my records .
And I was told the tribunal is not over my injury my pain and what I've lost . It's a legal thing whether it's work cover cause work and insurer are saying it was a work social and not work .
Then this afternoons ENT appointment they lost my second appointment months ago complained I didn't take the CT scan in last week they complained I had one .
I'm not saying what they found and think I may have its supposedly not contagious but I was alone in a room with four women today One touched my arm.
But 6 months to tell me next month an MRI
Assuming I don't need to be in hospital
If I do I've infected my family and so many people
I was in a bus crammed full of people from the airport i could have infected them

Specialist has already said I can't do 8 hours manual work yet .
April 21 I gotta have an MRI April 26 got see ENT doctor if what they think is in my brain I'm not certain work will wish me to return .
I hope it's not contagious like they say

Ent would be ears, nose and throt doc mate. Likely hood they would want to check for any inner ear issues.

Regardless take care big fella.

Thanks Stan
Yeah with my fractures my right ear has one behind it
Basically neurosurgeon is saying the bubble in the fracture behind the ear drum is blood .
And the ENT is saying it's not blood I think he said brain fluid
I'm having an MRI April 21 I won't say in the open what they think it is .
I was supposed to get the results April 26 but the tribunal is demanding I attend so I can't get the results until May 3 .

Just a quick update not much going on with me I finally after hassles from my employers insurance company and my injury being classed as permanent I finally got incapacitated benefits. My nominee and I asked for sickness but Centrelink refused long story money wise means the same amount,
I've been sent to a nuero specialist by the insurance company for the tribunal . Basically they have a ethnic Indian witness ( no offence meant ) who would be on a huge wage for my company .
His statement is saying I was drunk or high or having a medical episode .
They keep saying I was drunk paramedics took blood I was sober insurer refusing to accept that .
And this specialist had to be honest he could not confirm what this witness saw of me ie my eyes rolling . That by itself does not mean I was having a fit ,
He wasn't happy I'm not working even saying I'm not medically cleared he didn't accept or my employer demanding I'm a 100 percent preinjury fit .
And he trawelled through a legal medical book saying I should be driving
But he accepted grudgingly I have cognitive brain issues
At least the insurance company spent a fortune to find zero
