Yeah - so brings the point of if guy 1 loses his job and it was sent from a fellow work mate - they'd have to lose their job as well??

Depends if the fellow work mate has deleted the email. The way I understand it is you can be fired if those things are found on your computer. Even if the emails come from your Manager and the boss can see that, if its not on your managers computer he can't be fired.
Thats the way our HR guy explained it to me at my previous job anyway.
