Company policy or Law??

when a position becomes available within a company ..MUST that company adveritse the position even though the position will go to some1 with the company or have already POACH another person

As far as I know it is a legal requirement here in the UK and has been for several years now. I remember the civil servants I worked with when government departments were forced to adopt the system threatened to go on strike as they thought it would mean outsiders coming in and starting further up the 'ladder' than them.

I wouldn't be surprised if it was also a legal requirement for you guys too.

I doubt it, I know with even government jobs even though its policy not every job gets advertised, they can slide people sideways or upwards into a job as they see fit.

SA public service can only do that for temp positions, they are required to advertise full time positions (some are advertised internally within govt, some are put to open call and advertised in the media)
I would doubt that it was a requirement in the private sector.

true, I am in a federal government department and our department does this, in fact they put out expressions of interest internally for temp positions too

They are not legally required to advertise however if they have a written policy that they will advertise then you can challenge them to do so.

I imagine they would appoint the same person, either way.

I work for a major Japanese multinational that recently unincorporated themselves off the ASX, and all the cushy permanent day shift jobs, they know who is getting the job before it is advertised(internally). If your not one of the boys you don't get a look in.

No - why would you spend potentially $1000+ for no point?

You can do what you like there's no legal requirement to advertise a job or not advertise one - recruitment is an expensive process, companies do whatever thet can to keep the costs down

70% of jobs are never advertised at all. Instead they go to people who may have contacted the organisation, dropped off their CV etc. If you are looking for work, be pro-active and approach the businesses, don't wait until they approach you.
