Advice Needed re Parking Fine

Got a notice today saying I have to pay a $329 parking fine issued by the courts (or something like that) immediately or my car will be deregistered.
It was the first time I'd heard anything about it. :?
Apparantley on the 28th of September last year the Prospect Council say I was parked over a yellow line.
Ive looked back on the date and it was banner making night and I know for a fact I was one of the first there and didn't drink that night so remember quite clearly parking in a legal car park (there was a choice of hundreds!). Add to the fact I never park illegally as people who do peeve me off no end.
No notice was left on the car, no contact until today.
Obviously I don't want the car deregistered and the money isn't a huge amount but I feel pretty aggrieved about the situation.
Only complication is that we salary packaged our car so prior notice MAY have been sent to our employer which didn't get passed on.
Any advice on what I should do?

The first step is probably to get a stat dec stating that you never received your fine and send it to council.
Pretty much use the story you've told here.
$329 is a fair whack, but, remember if it goes further it could cost you more. So check what you do carefully before embarking on this.

Can you not plead your case on the bsis that the notice went to your employer.
Maybe check with them and see if they know anything. surely there would have been reminders. I know we get two or three chances over here to pay before it gets to court.

If your employer does know something, maybe they could write a letter on your behalf.

Good luck appealling to the better side of Prospect Council - they don't have one when it comes to $$. Stat decs from employer regarding no letter and from someone at NAFC that could attest to how many parks were available and where the banner making crew were generally parked may also assist.

Mrs got it through work.

The current fine include's debt collectors and court costs, original thing was probably $20 which I would have paid at the drop of a hat even if I wasn't guilty.

Its weird because I would have parked in one of two spots, either in front of the croquet club which has paralell parking, there's no way I would have been over a line as Im as careful as buggery with my newish car (would have been 4 months at the time) making sure I leave equal distance between lines so the car's less likely to get scratech by other parkers , or next to the park which is normal horizontal parking in inlets, to be over a yellow line you'd have to be outside of the of inlet which Ive never been close to. I only park my car where there's plenty of room.
And its not like I don't know any local rules or regulations as Ive been parking near to Prospect Oval for nigh on 25 years.

Put that info in your own stat dec as well then.

Bombard them with enough stat decs and they may roll over.

AN Englishman issued a ticket for speeding in the Adelaide Hills has had the fine withdrawn because he's never been in Australia.

David Smart, a 65-year-old former surveyor from **** in northern England, was flabbergasted to receive a speeding ticket from South Australian Police.

He was fined $196 for driving 8km/h over the speed limit in Littlehampton in the Adelaide Hills.

SA Police said today they issued Mr Smart the ticket after the registered owner of the speeding vehicle, Kathryn Julia Fluin, signed a statutory declaration declaring the Englishman was driving the car at the time of the offence.

"I've never been to Australia, which is a wonderful country I'm sure, and I would love to go there one day," Mr Smart said.

"And I've never had a ticket in my life, I'm pleased to say.

"The woman is obviously mistaken and where she got my name and address from I have no idea."

After consulting with **** police, Mr Smart was advised not to pay the fine, which originally arrived in his letterbox last December.

However he received a stern reminder from SA Police, ordering him to pay up or risk being issued an even heftier fine.

The fine stated the car was caught speeding at 68km/h in a 60km/h zone on Adelaide Road, Littlehampton, at 9am on December 14, 2007.

The fine said Ms Fluin "affirmed in a statutory declaration that you were the driver of the vehicle at the time of the alleged offence".

"I went to my local police station and they advised me against payment because I haven't been there," Mr Smart said.

"I think if I get caught for speeding I'll have to give them Kathryn Fluin's name.

SA Police business services director Denis Patriarca said today Mr Smart had been exonerated.

"As the nominated driver has disputed being the driver of the vehicle at the time of the alleged offence, his expiation notice has been withdrawn and police are following up with the registered owner," he said.

Ms Fluin, who couldn't be contacted today, is likely to be charged with wilfully making a false statutory declaration, which carries a maximum penalty of four years jail.

Keep an eye on the letter box then JTC it could have an envelope from the Prospect council in it.

Nup, it'll be straight from the Magistrate's court. ;)
Anyway, Ive started the ball rolling. The Magistrates court are sending me a form to complete which 'should' get the fine reduced to its original amount of something like $50. I can then discuss with Prospect council if that amount should stand or not.
Apparantley parking inspectors arent legally required to put a notice on a car that they write a fine out for. Am I a frigging mind reader?
Looks like we all better ring up every single council on a weekly basis asking them if theyre fining us that week if we dont want something to end up in court. FFS! I hate dealing with morons but will remain calm. Serenity now!

Yes Wedgie stay Calm until after you pay the fine then give the council both barrels .
