The courts are probable being "guided" by "administrative instructions" from the relevant state government.
Years ago the SA government, under John Bannon, appeased the Womens Electoral Lobby by using this technique to stop Magistrates declining to refer rape accusations to Court if there appeared to be insufficient evidence to justify the case proceding. A Barrister friend of mine said at the time. "If you get in a lift with a woman and she turns to you and asks you for $5000 to not claim rape, pay her. It will be cheaper than the minimum cost of a defence."

I read that case on the weekend - I dont care if he's f#%ing pink - Mofo deserves the maximum + some good old basic medieval justice

I have no problems with the piece. Well written and researched.
However, why did Bolt have to clarify that he was likely to be called a racist?
Has he had that suggestion before?

`He might have - How about you read the judgement and tell us what you think about it. The press tend to pick out what they want to justify the story, but this one is going to be a hardy to justify a non custodial sentence - IMO only of course - and no, I haven't read it. Maybe I should instead of spending 2 hours on here tomorrow!! Do something constructive for a change

My comment was directed to his lack of understanding about the law regarding sentencing Aboriginal offenders, not the specific case. He also doesn't seem to understand suspended sentences at all.

He's point about this so called 'lenient' sentencing is that it is delibarately done as a method to reduce statistics of Aborigines in custody. He doesn't realise that it actually relates mainly to the offender's culpability and personal circumstances. Culture will be relevant to both of these.

How the hell can personal circumstances influence the sentencing in a case like this?? Being from a troubled background doesn't change the crime if anything it probably increases the risk of re-offending. To say because they've had a "hard life" they need some leniency is bullshit. Of course this is just my opinion and I can see how some cases need some consideration but this is not one of them.

I actually read the original description of the sentence on the weekend before the Bolt article. It said that the Judge had trivialised the resultant trauma

I'll see if I can find the article - the case was a lot worse than Bolt has described

I hear you abour sentencing issues Shrek, but 4 year olds?? FFS, society, especially the most vulnerable, deserves protection from animals who cant help themselves (and that is said in the most derogatory manner, not that people like this bloke are vulnerable themselves)

Government seeks appeal over man who raped NSW girl

THE NSW government has sought urgent advice from the Department of Public Prosecutions (DPP) on the possibility of appealing against a suspended sentence given to a man who raped a four-year-old girl.

Attorney-General John Hatzistergos said the 24-year-old man pleaded guilty to sexual intercourse with a child under 10 and was given a two-year suspended sentence in the Downing Centre District Court in Sydney on February 6.

The sexual assault happened at South Grafton in November 2007, he said.

"Yesterday, when this was brought to my attention, I immediately contacted the DPP seeking urgent advice on whether they could appeal," Mr Hatzistergos said in a statement today.

"I understand the DPP is examining its options in this case."



The man broke into the house where the girl was sleeping and sexually assaulted her on November 22, Fairfax media reported on Tuesday.

He was arrested five days after the attack after a DNA match was found with some clothing at the scene, Fairfax said.

The NSW opposition has called for the sentence to be appealed.

Opposition attorney-general Greg Smith said the suspended sentence sent a poor message to the community.

"The community have a right to expect the punishment to fit the crime," Fairfax quoted him as saying.

My comments were about sentencing in general, not on this particular case. I don't know enough about this case but you'd have to say that suspending a sentence for such a crime is unusual.

Does NSW publish it's sentencing remarks, anyone know where?

Good old Rick Sarre had a letter in to the paper quick as you like, defending the different treatment of offenders based on their background. We are going down a black hole with this stuff.

i just cant get over how a father can get bashed in front of his family on a beach and the offender receives 5 years...
It leaves me feeling sick with rage.
