Cupido ban moves to Supreme Court

September 14, 2006 SANFL club South Adelaide has launched a Supreme Court challenge to a suspension of its star player Damian Cupido.

Cupido, a former AFL player for Brisbane and Essendon, was suspended on Tuesday by the SANFL tribunal for one match for striking.

The ban means Cupido will miss South's elimination final against Port Adelaide on Sunday - the club's first finals match in 14 years.

Cupido, who has dominated the SANFL after being cut last year by Essendon, was outed for striking Glenelg's Justin McConnell during last Saturday's final home and away round.

But South Adelaide general manager Ben Kavenagh said television footage screened at the tribunal showed Cupido made minimal contact to McConnell's chest with an open hand.

It was not immediately known when the Supreme Court challenge would be heard.

"Normally we would not dream of such action," Kavenagh said.

"But following what we view as an extraordinary decision, and the fact that there is no appeal mechanism in place, we believe we have an obligation to our club, Damian and the members to have the matter reviewed at a higher level.

"Unfortunately the only avenue open to us is a hearing in the Supreme Court."

Kavenagh said the lack of an appeal mechanism forced the club to take the legal action.

"The matter is now in the hands of our solicitor," he said.

No matter if Cupido hit him in the head, neck or chest, he still hit him, which is reportible, and therefor he deserves that one game suspension. If he's dumb to hit another player, he deserves to get suspended.

Maybe he moved it to the Supreme court because he thought a Supreme Court was something like a Super Supreme Pizza?

The hearing in the Super Supreme Court is 12 noon tomorrow so it'll be interesting to hear what happens tomorrow afternoon.

Is this just a ploy to get cupido to play or are south serious about over turning the suspension.

I remember that in 1996 the Sydney Swans did a similar thing.... as did Greg Williams.... my understanding was that the suspensions were delayed until a decision could be made but eventually upheld.

The big fear is that the court will delay the suspension until after the finals... Footy needs to stay out of the courts

In soccer any club going to the supreme court would be suspended.

Curtis did practically the same thing and got off.

It's funny the different treatment that Clarke and Cupido have got this year.

If a North Adelaide player got suspened for that, I would want my club too take it to court as well. Terrible verdict and punishment.

Did you see it or were you too wrapped up in believing your club's coach when he sprouts that Port are the equal of the other top sides? Still it won't matter if Cupido misses or plays because South should belt Port Adelaide and won't that be enjoyable.

Prehaps GFC should take the SANFL and SAFC to Supreme Court for breaching celery cap and make them lose points. I would do anything to be able to watch Glenelg play on Sunday.
