But the question is what would be illegal about not being confident of your own horse and laying it??? Nothing.
There are many times that I would have liked to back against my own horse (without taking the field). It is not the owners responsibility if so called industry experts and form analysists make any horse favourite. Unless it can be proved that a race was deliberatelty lost (or never going to be won due to undisclosed problems with the horse - ala Freedman and OSJ) there would be no cheating or wrongdoing.
The question is "how on earth would stewards (and/or any other regulatory authority) be able to determine foul play??"
The answer is "with great difficulty" and I would say unless the circumstances were very clear (ie pulling up a horse) then they would not have the evidence to punish the offenders.
