A Limiting Term is a court imposed period under mental health supervision which is equivalent to the jail term that a mentally well person would have received.

There is a small possibility that he will be released later in life, if it is deemed acceptable by a doctor. Should that occur, he will be released under supervision with continued treatment.

Well that's different that's as it should be I was under the impression under supervision of a mental health person meant free but has to check in with them daily or weekly or something. Why haven't they just said he will be going into an institution until deemed acceptable to be released back into society?

Because that's a given.

It should be but certainly wasn't with the mealy mouthed reportage of the 'sentence'.

Many people who knew him have 'allegedly' said he took various types of drugs over the years.
This was well reported in the media as well..... Not saying the media always get it right.
Whether he did on the night of the incident and whether that affected his mental illness we will never know.
But a judge has ruled it was mental illness that was the cause..... This is how it will be forever recorded.

Drugs are no good for anyone!!!

From the judge:

"I accept the toxicology evidence regarding tests performed on blood, urine and hair samples taken from Walsh following the conduct which confirm he was not intoxicated by any substance at the time of the conduct.,"

Cy Walsh, the son of former Adelaide Crows coach, Phil, has been detained for life under a mental health order over the death of his father.

Walsh was found not guilty of the murder of his father in September this year, for reasons of mental incompetence.

Yeah, and now his mum is claiming she wants the courts to give her permission to have CY live with her? Really? Who would want to live next door to a person that believed his own father was the devil and has to be monitored for the rest of his life. So that he doesn't re-offend. He should be in jail like the rest of those that don't want to live in society of peace.

Correct

Yes but we are saying the drugs certainly played some part in this..... Which for some reason is being ignored by the judge.

People with Schizophrenia or Bipolar Affective Disorder are more likely to use illicit drugs if they find make them feel better (transiently) even though they may make their condition obviously worse to the outside observer. On the other hand some illicit drugs can induce psychotic episodes in people who don't have those conditions and each episode leaves some residual effect.

The net result is that over time you can no longer tell which came first.

Am sure people are aware and would be on the 'net anyway but was in Perth just before last years AFL grand final and there was a double page story where it said that Phil Walsh got dispensation from the Power to have the final home and away game of the 2014 season off to go over to Perth (where Cy was still living at the time) and sort out some issues with him and during this time they ended up having a scuffle in Hay Street - I don't remember ever seeing this story in the Advertiser?

THE son of slain Adelaide Crows coach Phil Walsh has been granted limited, closely-supervised release from a secure mental health facility to receive medical treatment for relapsing-remitting multiple sclerosis.

On Tuesday, the Supreme Court approved licence conditions first mooted by counsel for Cy Jacob Walsh, and agreed to by the Office of the Director of Public Prosecutions following seven months of negotiations.

Imposing the conditions, Justice Anne Bampton noted Walsh had abandoned the second part of his application — that he be given “rehabilitation leave” to boost the work of MS specialists.

“Walsh’s schizophrenia is stable, and he has had an excellent response to antipsychotic medication,” she said.

“Psychiatrists are of the opinion he will comply with any conditions — one psychiatrist considered Walsh would only need to be accompanied by one supervisor.

“All agree he is ready to be offered the opportunity to show he can be trusted in the community, which is also necessary for his ongoing (mental health) rehabilitation.”

Walsh, 29, has been held in the secure James Nash House mental health facility since he was found not guilty, due to mental incompetence, of murdering his father.

He repeatedly and fatally stabbed Phil Walsh inside the family home in 2015 while affected by undiagnosed, untreated schizophrenia.

Prior to the fatal confrontation, Cy Walsh had been a habitual users of hallucinogenic drugs, had brawled with his father in the streets of Perth and spoken of wanting to “rip out” the older man’s heart.

In 2016, Justice Anne Bampton ordered that Walsh spend the rest of his life under a limiting term — psychiatric supervision similar to a jail term a mentally able person would receive.

Last year, Walsh’s counsel asked he be granted limited, closely supervised release on “humanitarian” grounds for multiple sclerosis treatment.

On Tuesday, Tricia Johnson, for Walsh, said her client’s application had narrowed.

“Following discussions with prosecution, we have in essence agreed that at this point the court should grant medical leave only,” she said.

“We’re asking the court to order further reports to update itself, in three months’ time, as to whether how he has responded to medical leave and if his behaviour has been appropriate.

“If it has, we will then ask the court to approve rehabilitation leave.”

Justice Bampton granted Walsh permission to leave James Nash House for scheduled medical appointments, accompanied at all times by two members of the facility’s staff.

She ordered the further reports and adjourned the matter until September.
