Fred and Barney don't like to be made to look like fools. So the court action taken and the subsequent penalty overturned they take personally ( make no mistake, the tribunal is supposedly independent their finger prints are all over it). So to drag him back in and give him 2+1 is a win for Fred although he still wouldn't have slept well. Any other elbow is 4-8 past history or not. It's not the only time recently Broadview have mad them look stupid, the overturned decision of 6 weeks on one of their players represented by a police prosecutor. He tore strip's off the tribunal and made the Old Scholars witness look stupid and the tribunal and Fred and Barney. If teams had access to half decent representation half the reports would be thrown out.

Oof do I have some thoughts about representation after some recent experiences.

I know at least two criminal barristers, who often act in the AFL Tribunal, who point blank refuse to attend the tribunal for what we'd politely call reasons

That's interesting ..... the Court references the tribunal as grading his striking charge as Careless/High/Medium, but in the summary issued by the League they had it as Intentional/High/Low. Bit of a difference.
